1. Acceptance of Terms
By downloading and using Viamove, you agree to comply with and be bound by these Terms of Service as well as the Apple Standard End User License Agreement (EULA) which can be found here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree, please do not use the app.
2. Description of Service
Viamove provides tools to track and analyze your walking activity. Certain features, such as "Ghost Walk" and "Weather Intelligence," are part of our Premium subscription.
3. User Conduct
You agree to use Viamove for lawful purposes only and in a way that does not infringe on the rights of others. You are responsible for ensuring that you are physically fit for walking and exercising. Use the app at your own risk.
4. Intellectual Property
All content, logos, and software within Viamove are the property of Ridge View Code, LLC and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the app without our permission.
5. Disclaimers & Medical Warning
Viamove is provided "as is" without warranties of any kind. Medical Disclaimer: Viamove is not a medical device. You should consult a physician before beginning any new exercise program. We are not responsible for any injury, health complications, or death resulting from your use of the app.
We do not guarantee the accuracy of location data, activity tracking, or weather intelligence. Use the app at your own risk and remain aware of your surroundings at all times.
6. Termination
We reserve the right to terminate or suspend your access to Viamove at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
8. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in the State of Wyoming. You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes through the app or website.
10. Apple App Store Supplemental Terms
The following terms apply if you accessed or purchased Viamove through the Apple App Store:
- Acknowledgement: You acknowledge that these Terms are between you and Ridge View Code, LLC only, and not with Apple. Ridge View Code, LLC is solely responsible for the app and its content.
- Maintenance and Support: Ridge View Code, LLC is solely responsible for providing maintenance and support services for Viamove. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty: In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
- Product Claims: You acknowledge that Ridge View Code, LLC, not Apple, is responsible for addressing any claims related to the app, including product liability, legal/regulatory non-compliance, or consumer protection/privacy claims.
- Intellectual Property: You acknowledge that, in the event of any third-party claim that the app infringes that third party’s intellectual property rights, Ridge View Code, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
